Construction Accident
Our client was a non-union laborer who spent a significant portion of his adult life in prison. After paying his debt to society, he obtained a job in the construction field working in the field of demolition. While working on a condo-conversion project in New York City, he was injured as a result of a temporary floor which collapsed. Chaikin Trial Group was able to obtain summary judgment on liability and secure a settlement of $5,450,000 for our clients neck, back and shoulder injuries.

Our client was a pedestrian crossing the street when her foot was run over by a New York City Sanitation truck causing her to fall to the ground and injuring her left foot, shoulder, neck and back. As a result of these injuries, the client was required to undergo neck and back surgeries with hardware implantation at one level of the cervical spine. Our team obtained summary judgment against the defendants on the issue of liability early on in the case and was able to use that pressure to resolve this case years before any trial date could be obtained.

Our client was rear-ended in Queens while on his way home. The defendants alleged that he stopped suddenly and without cause. As a result of this accident, our client sustained neck, back, shoulder and knee injuries. He underwent right Knee, cervical and lumbar surgeries with use of hardware at one level of cervical spine. The client, a woman in her 60’s, sustained shoulder, knee and lower back injuries which required surgeries without use of hardware. She had significant prior back problems where she complained to the doctor that the pain was unbearable. Upon taking over the case, our team immediately began applying pressure on the defendants. This pressure resulted in the defendants replacing their attorneys with one of New York’s top defense firms. Despite this, our team was able to resolve the matter within 5 months of being retained for $2,100,000.

Our client, who was involved in a sideswipe collision with a flatbed truck, sustained back and shoulder injuries. As a result of the injuries, he was required to undergo arthroscopic surgery of the shoulder and lower back surgery which did not include use of any hardware. The defendants strongly argued that our client was at fault for the accident and also had surveillance of him following surgeries appearing to be perfectly fine. At a court conference, our team was able to negotiate a significant resolution despite the difficulties with the case.

Ceiling Collapse
Our client, a woman in her 60’s who was on disability at the time of the accident, was taking a shower when a portion of the ceiling collapsed on her head. As a result of the accident, she injured her neck requiring surgery with a second adjacent level surgery a couple of years later. The defendants argued that the injuries were not from the accident and they were age related and that surgery was not needed. Our team was able to establish that the defendants knew of the condition which caused the ceiling to fall and that the accident made her age related conditions worse. At a mediation, we were able to successfully resolve the matter for $1,750,000.

Trip and Fall
Our client was walking on a busy New York City sidewalk in Downtown Manhattan when she tripped and fell over a sidewalk that was misleveled by a quarter inch. She did not report the injury to anyone at the time of the accident. After the fall, she got up and went home by subway and went to the hospital the following day. The defendants claimed that the defect was trivial and could not have caused a fall and further pointed out that the client after being injured but before having back surgery, reported her back as feeling fine. As a result of this fall, she injured her knee and lower back both which required surgeries. Our team was able to prove that the defendant knew of the defect and failed to repair it. At a mediation, we successfully negotiated a settlement in the amount of $1,450,000.

Car Accident
Our client was a passenger in a limousine that was t-boned by another vehicle when the limousine made an improper u-turn. Our client sustained a broken tibia which required surgery and a broken jaw which required wiring. As a result of the surgeries and the shattered glass, our client sustained multiple scars throughout her body as well. This accident was tragic and heartbreaking as 4 young girls in the limousine were killed and 3 others severely injured. At a mediation held prior to trial, a group settlement was achieved in an amount of $6,100,000 with our client share being $1,102,270 – the highest of the other 6 passengers.

Fall
Our client, a woman in her 60’s, was injured when she was caused to fall as a result of being startled. While exiting a building in the Bronx, our client pushed a door open which struck a garbage pail placed in a location that did not allow the door to open fully. The sound of the impact started the client causing her to trip over her to lose her balance and fall. She could not reach the handrail because the garbage pail prevented her from doing so. Our client sustained a fractured knee which required surgery with use of hardware. She subsequently needed another surgery to remove the hardware. The defendants argued that the plaintiff was at fault for not seeing the garbage pail as she opened the all glass door. Despite the defendants’ position, a settlement in the amount of $1,000,000 was achieved.
