This morning, a construction worker tragically lost his life after falling approximately 50 feet down a shaft at a Hudson Yards work site on Manhattan’s West Side. The accident occurred around 9 a.m. at 605 W. 30th Street, according to ABC7 New York and CBS New York. Emergency responders rushed the worker to the hospital, but he sadly did not survive his injuries.
Construction Accidents in New York Are Preventable
Every year, construction workers across New York City are seriously injured or killed in falls from height — one of the most common and most preventable workplace accidents. These incidents are often the result of unsafe working conditions, defective equipment, or the failure to provide proper fall protection.
Under New York Labor Law Sections 240 and 241, also known as the Scaffold Law, property owners, general contractors, and site managers have a legal duty to keep workers safe. When that duty is violated, injured workers or their families may be entitled to compensation through a third-party construction accident claim or a wrongful death lawsuit.

Legal Rights After a Construction Site Death
If a safety device, such as a harness, guardrail, or scaffolding, was missing, defective, or improperly secured, the worker’s family may have the right to pursue a wrongful death or third-party construction accident claim. In addition, surviving family members may be eligible for workers’ compensation death benefits, though those typically do not cover full damages for pain and suffering or negligence.
